Today (2025.05.06), the working group responsible for drafting the revised versions of the Law on the Constitutional Court of Mongolia and the Law on the Procedure for Adjudicating Cases in the Constitutional Court, led by Member of the State Great Hural (Parliament) L. Munkhbaatar and including Members D. Tsogtbaatar, Kh. Baasanjargal, and O. Nominchimeg, held a meeting with a delegation headed by Marta Cartabia, Vice-President of the Venice Commission of the Council of Europe.
At the beginning of the meeting, Member of the State Great Hural (Parliament) and Leader of the Mongolian People's Party faction in the Parliament, L. Munkhbaatar, emphasized that Mongolia has initiated the process of drafting the revised laws on the Constitutional Court of Mongolia and the procedure for adjudicating cases in the Constitutional Court with the goal of strengthening the democratic system and aligning the legal framework for protecting human rights with international standards.
He also expressed a desire for cooperation with the Venice Commission of the Council of Europe in providing recommendations and advice on the draft laws. Furthermore, he noted that developing both the theoretical and practical understanding of constitutional law is critically important for ensuring the guarantees of democracy.
Additionally, L. Munkhbaatar highlighted the need to include detailed provisions in the revised draft laws regarding the legal regulation of complaints and disputes submitted to the Constitutional Court, the criteria and requirements for its members, the transparent and open process of nominating and appointing them, ensuring guarantees of their independence, and clearly defining the procedure for adjudicating disputes related to fundamental civil rights.
Marta Cartabia, Vice-President of the Venice Commission, remarked that the Constitutional Court is a key institution for the protection of human rights. She emphasized that when regulating the adjudication of human rights-related disputes, it is especially important to focus on how the decisions impact citizens in practice.
She also expressed the Commission’s readiness to provide specific recommendations and advice on the draft revised laws on the Constitutional Court of Mongolia and the procedure for adjudicating cases in the Constitutional Court.
